PLEASE NOTE:  All bookings are accepted under the presumption that the clients booking have read and agree to our terms and conditions of hire prior to sending the booking request. 

1. General

1 General

1.1 These Terms and Conditions apply to all equipment hired from Squiggles (“the Company”).
1.2 By confirming a booking, the hirer agrees to be bound by these Terms and Conditions.
1.3 The Company reserves the right to update these terms at any time.

2. Hire Period

2.1 The hire period begins from the time the equipment is collected or delivered and ends when it is returned or collected by the Company.
2.2 Late returns may incur additional charges.
2.3 Extensions must be agreed upon prior to the end of the hire period.

3. Booking & Payment

3.1 All hires include an up-front deposit in order to reserve the items to be hired, which must be paid as per the dates given on the invoice.

3.2 A booking is confirmed once the deposit has been received and booking has been confirmed in writing by the Company.
3.3 Full payment must be made prior to collection or delivery unless otherwise agreed.

3.4 Payments arrangements can be made upon agreement approved by the Company.
3.5 Prices are subject to change without notice but confirmed bookings will honour agreed pricing.

4. Bond

4.1 A refundable bond/security deposit will be required for all hires.
4.2 The bond amount will be advised at the time of booking and must be paid before equipment is released.
4.3 The bond will be refunded within 5 working days after the hire period, subject to inspection of the returned equipment.
4.4 The Company reserves the right to retain part or all of the bond to cover:

• Damage to equipment

• Loss or theft

• Excessive cleaning requirements

• Late return fees
  4.5 If costs exceed the bond amount, the hirer agrees to pay the additional charges.

 

5. Delivery, Collection, & Setup

5.1 Delivery and collection fees may apply depending on location, these will be quoted and must be accepted in writing before the booking is confirmed.
5.2 The hirer must ensure safe and reasonable access for delivery and setup.
5.3 The Company is not responsible for delays caused by access issues or unsafe conditions.
5.4 Setup and pack-down services are only included if agreed in writing and will come at an extra cost, to be quoted and accepted prior to booking confirmation.

5.5 All delivery or collection locations shall be arranged prior to booking confirmation.

5.6 All collection hires shall be free of collection charges if they are collected within the Hikurangi District.  Any collections outside of the Hikurangi District may incur a small collection fee.

6. Use of Equipment

6.1 Equipment must be used only for its intended purpose and in a safe manner.
6.2 The hirer is responsible for ensuring equipment is supervised and operated correctly.
6.3 Equipment must not be altered, modified, or tampered with.
6.4 The hirer assumes full responsibility for any injury, loss, or damage arising from use.

6.5 The hirer agrees to only use the equipment for the purpose stated within booking discussions, no sub-letting or other such arrangements shall be made by the hirer.

6.6 The hirer shall not use the equipment in any way that provides income to the hirer, unless for fundraising purposes that has been discussed and approved by the Company prior to booking confirmation.

6.7 All age restrictions quoted by the Company shall be adhered to at all times.

 

7. Damage, Loss, & Cleaning

7.1 The hirer is responsible for all equipment from the time of hire until return.
7.2 All items must be returned in the same condition as supplied (allowing for fair wear and tear).
7.3 Cleaning fees may apply if equipment is returned excessively dirty, and this will be retained from the bond or changed on to the hirer if the cleaning cost exceeds the bond amount.
7.4 Any damaged or missing items will be repaired or replaced at the hirer’s expense.

8. Cancellations & Refunds

8.1 Cancellations must be made in writing with the earliest notice period possible.

8.2 Deposits may be non-refundable depending on timing:

• More than 5+ days notice: full refund excluding 50% bond

• Between 2-5 days notice: 75% refund including 50% bond

• Less than 2 days notice: deposit and bond retained, balance refunded
  8.3 The Company reserves the right to cancel bookings due to unforeseen circumstances, in which case a full refund will be provided.

8.4 Rescheduling will be allowable free of charge one time, provided the new booking date is within 6 months of previous booking date.

8.5 Transfer of booking/deposit/payment to another event/person is allowable as per arrangement in writing with the Company, extra costs may apply if adjustments to original booking location and equipment required is made.

 

9. Weather & Outdoor Use

9.1 The hirer is responsible for protecting equipment from weather conditions.
9.2 All equipment is to be kept dry to the hirers best abilities.
9.3 Equipment damaged due to weather exposure may be charged to the hirer.

9.4 Equipment is not to be used in a sever weather event or during the period where a severe weather warning has been issued.

 

10. Liability

10.1 The Company is not liable for any injury, damage, or loss incurred during the hire period.
10.2 The hirer agrees to indemnify the Company against any claims arising from use of the equipment.
10.3 The Company’s liability is limited to the hire fee paid.

 

11. Insurance

11.1 The hirer is responsible for ensuring adequate insurance coverage, if required.
11.2 The Company’s insurance does not cover misuse, negligence, or theft while on hire.

 

12. Ownership

12.1 All equipment remains the property of the Company at all times.
12.2 The hirer must not sell, sublet, or dispose of any hired equipment.

 

13. Default

13.1 Failure to comply with these Terms may result in:

• Immediate termination of hire

• Recovery of equipment

• Additional charges or legal action

 

14. Governing Law

14.1 These Terms and Conditions are governed by the laws of New Zealand.

 

15. Acceptance

15.1 By hiring equipment, the hirer acknowledges they have read, understood, and agreed to these Terms and Conditions.
